Apply for a licence

Automatic Mutual Recognition (AMR) for the property agent industry has now commenced — see the AMR page for more information.

There are 4 types of licence:

  • Real Estate Agents (Part 1)
  • Property Managers (Part 2)
  • General Auctioneers (Part 3)
  • Property Representatives (Part 4)

Whether the agent is conducting business or not determines whether the name is entered into Division 1 or Division 2 of the relevant Part. The licence period is 1 July to 30 June each year.

National Police Record Check

The Board must be satisfied that all applicants hold relevant qualifications and are a fit and proper person to hold a property agent licence. In order to satisfy the fit and proper person test, the Board, with reference to Section 16 of the Property Agents and Land Transactions Act 2016, has determined as follows:

  • Tasmanian residents: the Board will only accept a National Police Record Check (NPRC) issued by Tasmania Police. Apply through Service Tasmania.
  • Interstate applicants who do not have a Tasmanian return address, or are not currently resident in Tasmania, must complete a National Police Record Check issued by the equivalent Police Agency in their home state. The Australian Criminal Intelligence Commission (ACIC) maintains a list of these Police Agencies.

NPRCs will only be accepted when issued by a Police Agency; they will NOT be accepted from accredited bodies. The National Police Record Check that accompanies the application must be issued within the 3 months before the date the application is lodged with the Board. When completing the police check form, the purpose category is “general employment”.

Insolvency check

An applicant must provide evidence of being a fit and proper person in relation to their solvency. The applicant is to provide an extract or a result report from the National Personal Insolvency Index (NPII) maintained by the Australian Government’s Australian Financial Security Authority. The extract or result report from the NPII is to be issued not more than seven (7) days before the date of lodging the application for licence.

Licence changes

Application to manage more than one office

If you are wishing to manage more than one place of business, all authorised places of business must be in the same ‘region’.

Fee for amended and replacement licences

A property agent is required to keep his or her details up to date and therefore must advise the Board of a ‘change of details’ so the Register can be amended. Such changes may include:

  • Employer change
  • Change of name
  • Change of residential address

There is no charge to make a change to the Register.

The Board issues a soft copy licence when a new licence is granted and at renewal. There is no requirement within the Act that a property agent must display a licence or that the Board must provide a hard copy licence to a property agent.

The Board has determined that if a property agent requires a copy of his or her licence in other circumstances, a fee will be imposed to produce and email an amended or a replacement licence during a licence period (1 July – 30 June). Such circumstances are as follows:

  • If the property agent changes his or her employer
  • If the property agent changes his or her residential address
  • If the property agent changes his or her name
  • If the property agent requests a copy of the licence

The Board has determined that the reissue of a licence during a licence period will incur an administration fee of 10 fee units. Fee units are automatically indexed every financial year; in the current financial year a fee unit is $1.96.

The Board will notify the property agent who has requested a change of details to the Register by email once the Board Register has been updated to reflect their change of details.

Property agent means a real estate agent, a property manager, a general auctioneer, or a property representative.
